Does Your Estate Plan Address Your Rental Properties?
A great estate plan is not the same as a protected portfolio. In this episode of Trust This, Asset Protection Attorney Joe Seagle steps away from the Wealth Council Symposium in Las Vegas to answer one of the questions he hears most: what is the difference between an estate planning lawyer and an asset protection lawyer? Joe walks through a real-world example of investors who arrived with a polished, recent estate plan and ten Florida rentals, none of which had been moved into an LLC or a land trust. Using a simple construction analogy, he explains why the estate plan is the slab and asset protection is the frame, roof, and walls. He also covers why many trusts need to be updated to hold LLC interests, land trust beneficial interests, and S corporation stock. If you own rental property and assume your trust has you covered, this episode is worth your time. Dolly Parton's Greatest Lesson on Business
Dolly Parton’s professional relationship with country music star Porter Wagoner helped introduce her to a national audience through The Porter Wagoner Show. When Parton decided to pursue an independent career, she wrote “I Will Always Love You” as a farewell to Wagoner and “Light of a Clear Blue Morning” as an anthem for her newfound freedom. What initially appeared to be an amicable separation later became a difficult business dispute when Wagoner sued Parton for $3 million, claiming he was owed a share of her success. Parton eventually settled the lawsuit for $1 million, closing a painful chapter in one of country music’s most recognizable partnerships. Years later, Wagoner faced serious financial trouble and was forced to sell his music catalog. Rather than using his hardship to settle an old score, Parton quietly purchased the catalog without revealing that she was the buyer. She then returned the music to Wagoner as a gift, helping preserve his creative work and the legacy his children could inherit. In this episode of Trust This, Asset Protection Attorney Joe Seagle explores what Dolly Parton’s decision teaches business owners and families about business disputes, forgiveness, leadership, and legacy planning. Her story is a powerful reminder that protecting a legacy is not limited to contracts, property, or financial assets. It also includes the choices we make after conflict and how those choices affect future generations. 📧 Have a question you want answered on our next Ask Joe episode? How to Keep 100% Homestead Exemption on a Co-Owned Home
Florida TRIM notices are out, and property appraisers are taking a hard look at inherited homes that siblings and cousins own together when only one of them lives there. If you're in that situation, your homestead exemption may be about to shrink from 100% to only your share of the property. In this episode of Trust This, Asset Protection Attorney Joe Seagle explains a little-known quirk in Florida law: co-owners who hold title as joint tenants with rights of survivorship may keep the full homestead exemption, even when only one owner lives in the home. He covers how a corrective deed can fix the title, the survivorship trade-off every family should weigh first, and how to file a Value Adjustment Board petition with the clerk of court to protect your rights before your county's deadline. Joe then breaks down the property tax amendment on Florida's November 2026 ballot, including the larger homestead exemption, the lower cap for commercial property, new limits on what cities and counties can spend property tax revenue on, and the arguments on both sides. He also explains why every qualifying Florida homeowner should file for homestead before December 31, 2026, since those who don't may wait years before seeing the larger exemption. Listen to the full episode of Trust This, hosted by Asset Protection Attorney Joe Seagle, for the complete breakdown, and follow the show so you never miss an episode on protecting what you've built. How to Title Real Estate for Asset Protection
How you take title to Florida real estate is one of the smallest lines on a closing statement and one of the biggest decisions in an asset protection plan. In this episode of Trust This, Attorney Joe Seagle answers a question Aspire Legal Solutions hears from buyers and investors constantly: whose name should actually go on the deed? For married buyers, his default is simple. Unless there is a specific reason to do otherwise, both spouses should be on title, because Florida recognizes a form of ownership most states do not — tenancy by the entirety. Tenancy by the entirety is asset protection written into the deed itself. When a married couple owns Florida property as the entireties, a judgment against only one spouse does not attach to that property. A car accident, a contract dispute, a business claim — if the judgment runs against one spouse alone, the creditor is looking at an asset it cannot reach. Joe also explains a forgiving feature of Florida law that many owners never learn about: even when a deed fails to state the buyers' marital status, entireties protection can still apply if the owners sign an affidavit confirming they were married when they took title and stayed continuously married the whole time they held it. And he covers the alternatives — sole ownership, joint tenancy with rights of survivorship for co-owners who are not married, and tenancy in common, where each owner's share passes to that owner's heirs by will or by statute. For unrelated parties buying together, the firm usually recommends a land trust or an LLC instead, both for easier management and for protection individual ownership never provides. Listen to the full episode before your next closing, then subscribe to Trust This for new editions on Florida asset protection, land trusts, homestead, and estate planning. And whatever you do, talk with a Florida real estate attorney about how title should be held before you sign — not your realtor, not a friend, and if you are buying from out of state, not only the attorney who has handled your matters back home. 📧 Have a question you want answered on our next Ask Joe episode?
