Description
Douglas Stewart Carter Case Update: DNA Evidence, Wrongful Convictions & Utah’s Justice System | We Win Injury Law Podcast
What happens when a man spends decades on death row, only for new DNA evidence and serious constitutional violations to raise major questions about his conviction?
On this episode of the We Win Injury Law Podcast, Tyler Todd and Jaren “Copacabana Boy” Sandberg break down the latest developments in the Douglas Stewart Carter case, one of Utah’s most troubling and complex criminal cases, while sharing stories from Jaren’s recent trip to Brazil.
The episode starts with stories from Copacabana Beach, the incredible wildlife at Iguazu Falls, and Jaren’s experience meeting attorneys from major law firms.
Then, the conversation turns to Douglas Stewart Carter.
In 1985, Carter was convicted of the murder of Eva Olesen in Provo, Utah, and sentenced to death. After spending decades on death row, his conviction and sentence were vacated following findings of serious constitutional violations. In May 2025, the Utah Supreme Court affirmed the decision granting him a new trial.
In September 2026, newly analyzed crime-scene DNA evidence excluded Carter as a possible contributor to profiles obtained from blood on a doorknob and material on a knife handle. Prosecutors announced they would no longer seek the death penalty, and Carter was released on bail on September 28, 2026, with a GPS monitoring device. The aggravated murder charge remains pending, and the DNA findings have not legally established his innocence.
Tyler and Jaren examine the questions this case raises about wrongful convictions, witness testimony, alleged investigative misconduct, due process, and accountability. They also discuss whether the prosecution should continue, how resource and training gaps can affect the justice system, and the difficult questions surrounding potential civil compensation when constitutional rights are violated.
This conversation is about more than one case. It explores what can happen when the justice system gets it wrong, why evidence and constitutional protections matter, and what accountability should look like when serious failures occur.
